The whole point of the Employment Tribunals was to provide less formal, much cheaper and quicker justice to employees whose employers treated them badly. I have personally been on both sides of this issue and the problem is that politicians keep changing and widening the scope for claims, while not providing any safe haven solution for employers with a genuine issue to resolve.

By introducing employer penalties payable to HMG the low cost scenario is finally being killed; so why not just revert to the Courts?

Messing around with laws and procedures does not solve anything nor reduce business costs. Certainty and clearly thought out rules could do that. So far there is no sign of such an approach from the Conservative led coalition.

And kill the ability of workers to get any justice when abused by the Indian outsourcing movement

Yea that's great that will finally decimate the tech industry

It would be better to create a simple "freelance" status for employers who want staff they can hire and fire at will, and for staff who are happy with that, and make it easy to use and not need accountants etc as now

Then if both sides are happy with a freelance deal fine, and they can negotiate a higher price to compensate as needed

Employment tribunals should be heard without lawyers on both sides, take the "judge" title back of the people hearing them, and make it cheaper by forcing the employee and manager to meet informally in front of the hearing, it is the crazy legalification of what was "supposed" to be a process accessible to the layman that has pushed costs up

So the idea is to reduce the chance and extent of punishment for employers who are naughty in the hope they will employ more people. Who would want to work for those kinds of people anyway?

Better to reduce, simplify and clarify regulations then meaningfully punish individuals who break the rules. At the moment, naughty people are able to hide behind the fiction that a company is a legal entity and they can get away with much mischief.

Employee protection is a complete joke in this country, particularly when a company goes into administration. One 5K fine for breaking employment law in the case of 100's of victims demonstrates very clearly how seriously HMG takes upholding the law.
